Filing bankruptcy and in need of some advice?
Filing bankruptcy has several options and we saw some of them on the previous page. Let's continue with chapter 11 provisions.
A chapter 11 can be the only way for a consumer to declare a bankruptcy if the amount of the debt, such as an extremely large mortgage exceeds the requirements of a chapter 13.
In some of these cases it may be possible to "cram a plan" at debtors who are dissenting at the terms of the chapter 11 and force them to comply under a large debt load, such as a large mortgage.
If your not sure about which type to file, there are usually free lawyer referral services in each city or town that can advise you if your prepared with all your information!
4. The fourth way to go about bankruptcy is with a totally new chapter 12. Chapter 12 is simillar to chapter 13 except that there are no limits to the amount of debt that can be included in it.
Chapter 12 is available to family farmers and now the law covers family fishermen as well.
It would be wise to consult an attorney, even one who is working for a lawyer refferal service if your not sure how the new law impacts you. The new amendments to the bankruptcy laws also affect a chapter 12 as well as the others.
Now for the good news! Filing for bankruptcy does not mean you wont ever get credit again! In fact it may now be easier because your creditors know you cannot do so for another 7 years.
